Why Choose VLC Legal and Tax Advice?
Pseudo self-Employment: Are You Prepared?
With the upcoming lifting of the enforcement moratorium on pseudo self-employment, the Dutch Tax Authorities and Labor Inspectorate will enforce stricter checks on working relationships between principals, self-employed professionals and freelancers. Misclassified employment relationships can lead to retroactive tax claims, fines, and other sanctions for both self-employed professionals and freelancers, and their principals.
When does pseudo self-employment arise?
Pseudo self-employment occurs when a self-employed professional, or freelancer effectively works as an employee without formal recognition of the employment status. This can happen when there is a relationship of authority, fixed working hours, or structural dependence on the client.
